Divorce Appraisals in San Diego: Commercial Property, Rentals and Groves in a Marital Estate

Short answer: When a San Diego divorce includes commercial or investment real estate, each property needs an independent appraisal as of the right date: usually a current value near trial under Family Code Section 2552, and often a retrospective value as of the date of separation. San Diego family law cases go to one of four courthouses, in San Diego, El Cajon, Vista or Chula Vista, based on the court’s Zip Code List. San Diego adds its own value issues: short-term rental licenses that cannot be transferred, city tenant protections, the coastal zone and North County water district switches. PM Appraisal is based in San Diego County, appraises every commercial property type in every San Diego County city, and you talk directly to the appraiser on your assignment. Call or text (805) 990-9700.

San Diego marital estates often hold more than a house. A 1970s apartment building in North Park or El Cajon, an industrial condo in Kearny Mesa or Otay Mesa, a strip center in Escondido, a beach cottage in Mission Beach that has been run as a vacation rental, or an avocado grove in Fallbrook or Valley Center. In a divorce, the value of each one drives who keeps what and how much one spouse pays the other. Our statewide guide to divorce appraisals of commercial property covers the Family Code basics in depth. This page covers what is different when the property is in San Diego County.

Which San Diego courthouse handles the divorce, and who orders the appraisal?

The San Diego Superior Court runs family law business offices in four places:

  • Central Courthouse, 1100 Union Street, San Diego.
  • East County Regional Center, 250 East Main Street, El Cajon.
  • North County Regional Center, 325 South Melrose Drive, Vista.
  • South County Regional Center, 500 Third Avenue, Chula Vista.

The court’s Where to File page says most family law cases, including divorce (dissolution), follow its Zip Code List, Form ADM-254, with a few exceptions. Your attorney files the case. The court does not order the appraisal for you. It is usually ordered in one of three ways:

  • By one spouse’s attorney, to value the property for negotiation, mediation or trial.
  • Jointly by both sides, as a neutral appraiser both attorneys agree on, which can save the cost of dueling reports.
  • By a CPA or forensic accountant working on the case, who needs real estate values to build the balance sheet and the tax picture.

Our opinion of value is the same no matter who orders the report. We never pick a number to help one side, and our value conclusion is never tied to the result anyone wants.

What valuation dates does a San Diego divorce appraisal need?

Under Family Code Section 2552, the court values community assets as near as practicable to the time of trial. On 30 days’ notice and for good cause, the court may value all or part of the assets at a date after separation and before trial instead. Spouses who settle can agree on their own date.

A date of separation value can matter too. Family Code Section 70 defines that date, and it is the attorneys’ call. Once it is set, a retrospective appraisal values the property as of that past date with the sales, leases and market conditions from that time. That can be needed when one spouse ran a building alone after the split, when value rose or fell after separation, or when separate property money went into a community building and reimbursement under Family Code Section 2640 is in play.

In San Diego, the dates can straddle real changes: a short-term rental license granted or lost, a grove’s water district switch, a tenant protection rule taking effect. Tell us every date in play before the work starts so each value is supported on its own.

How is a short-term rental valued in a San Diego divorce?

This is one of the most San Diego specific issues in a marital estate. Under the City of San Diego’s Short-Term Residential Occupancy (STRO) ordinance, it has been unlawful to operate a short-term rental without a license since May 1, 2023. The city’s own page says:

  • Whole-home licenses are capped. Tier 3 whole-home licenses outside Mission Beach are limited to 1% of the city’s housing units outside the Mission Beach Community Planning Area, and Tier 4 Mission Beach whole-home licenses to 30% of Mission Beach housing units. As of the city’s October 2026 update, the Tier 4 waitlist is closed.
  • Licenses are not transferable. The city says STRO licenses are not transferable from host to host or property location, and licenses expire two years from issuance.
  • Use requirements apply. Tier 3 and Tier 4 licenses require at least 90 days of short-term rental use each year to keep the license.

For a divorce appraisal, that raises practical questions. Which spouse is the host on the license? If the other spouse keeps the property, can it keep operating as a short-term rental, or is it worth what a long-term rental or owner-occupied home is worth? An income figure built on vacation rental bookings has to be checked against the license, not assumed. We read the license status as of each valuation date and say clearly what the value assumes. Other cities in the county have their own short-term rental rules. General information; ask your attorney how the rules apply to your property.

What other San Diego issues change a divorce appraisal?

  • City of San Diego tenant protections. The Residential Tenant Protections Ordinance, San Diego Municipal Code Sections 98.0701 through 98.0709, took effect June 24, 2023, and limits when a landlord can end a tenancy. It does not cap rents; most rent increase limits come from state law in Civil Code Section 1947.12. For an apartment building, the in-place rents, the leases and the gap to market rents on each date drive the income approach.
  • Groves, nurseries and water. The Fallbrook Public Utility District began buying wholesale water from Eastern Municipal Water District on January 1, 2024, and the Rainbow Municipal Water District detachment from the San Diego County Water Authority was final November 1, 2024. Water cost is a large part of grove economics, so a date of separation before the switch and a value near trial after it can read different numbers. We appraise groves, nurseries and ranches, and the homes on them, along with the commercial property. See farm and ranch appraisals.
  • The coast. Property from Oceanside to Imperial Beach can sit inside the California Coastal Zone, where development is reviewed under the Coastal Act and each city’s local coastal program. What an owner can build, add or convert on a coastal lot is part of highest and best use.
  • Fire at the wildland edge. For backcountry and North County property, the valuation date decides whether the appraisal reads a property before or after a fire, and insurance cost and availability are part of the market. See casualty loss appraisals.
  • Many markets in one county. San Diego County has 18 incorporated cities plus large unincorporated areas. A Miramar industrial building, a La Jolla retail building, a National City fourplex and a Ramona ranch do not trade the same way. Comparable sales have to come from the right submarket and the right time.

How do you value several properties in one San Diego marital estate?

Consistently. When an estate holds a duplex in Ocean Beach, an industrial condo in San Marcos, a grove in Valley Center and a rental in Riverside County, each property gets its own report or its own section, but the valuation date, the assumptions and the level of support are the same across all of them. That keeps the division fair and keeps the argument on the facts. See multi-property portfolio appraisals.

A few things to settle up front:

  • Who holds title. When an LLC or partnership holds a building, we appraise the real estate. If the case needs the value of the spouse’s interest in the entity, that is a business valuation question for a business appraiser or CPA, who can use our real estate value as a starting point. See family LLC property appraisals and fractional interest appraisals.
  • Disclosure. Under Family Code Section 2104, each party serves a preliminary declaration of disclosure. Rent rolls, leases, STRO license records and booking history, water bills, operating statements and loan documents for each property make the appraisal faster and better supported.
  • Property that gets missed. Under Family Code Section 2556, the court keeps jurisdiction to divide community assets that were omitted from the judgment. A full property list at the start is cheaper than a postjudgment motion later.

What happens with property taxes and income taxes when one spouse keeps the building?

Generally, keeping a building does not trigger a new San Diego County assessment. Revenue and Taxation Code Section 63 excludes transfers to a spouse or former spouse in connection with a property settlement agreement or a decree of dissolution from the definition of a change in ownership. For federal income tax, Internal Revenue Code Section 1041 generally treats a transfer between spouses, or between former spouses incident to the divorce, as a gift, so the receiving spouse takes the transferor’s basis. Two buildings with the same market value can carry very different built-in tax costs, which matters when the CPA builds the division. Talk to your attorney or CPA about how these rules apply to you.

If the spouse who keeps a building later refinances to buy out the other spouse, the lender will order its own appraisal for the loan. A divorce appraisal and a lending appraisal have different intended users, so plan on separate reports. We do both: see private and hard money lending appraisals.

Frequently Asked Questions

What is a divorce appraisal in San Diego?

It is an independent appraisal of real estate owned by one or both spouses, prepared so the spouses, their attorneys, a mediator or the court can divide the marital estate. For San Diego County commercial and investment property, that means a supported market value for each building or parcel as of the valuation date the case needs, and often a second, retrospective value as of the date of separation. PM Appraisal is based in San Diego County and appraises every commercial property type in all 18 cities and the unincorporated areas.

Which San Diego courthouse handles a divorce?

The San Diego Superior Court has family law business offices at the Central Courthouse, 1100 Union Street in downtown San Diego, and at the East County Regional Center in El Cajon, the North County Regional Center in Vista and the South County Regional Center in Chula Vista. The court's Where to File page says most family law cases, including dissolution, follow its Zip Code List (Form ADM-254). Your attorney files the case. The appraisal is ordered by the spouses or their attorneys, not by the court clerk.

What date is commercial property valued as of in a California divorce?

Under Family Code Section 2552, the court values community assets as near as practicable to the time of trial. On 30 days' notice and for good cause, the court may value some or all assets at a date after separation and before trial instead. A settlement can set its own date. Your attorney decides which date applies, and we can appraise the property as of any of them, including a retrospective date of separation value.

How is a San Diego short-term rental valued in a divorce?

Carefully, because the license may not go with the property. The City of San Diego says STRO licenses are not transferable from host to host or property location, whole-home licenses are capped, and the Mission Beach waitlist is closed. A value that assumes short-term rental income has to be checked against who holds the license and whether the spouse keeping the home can keep operating it. General information; ask your attorney how the rules apply to your property.

Do groves and farms in North County need special treatment in a divorce appraisal?

Often, yes. Water cost drives grove value, and the Fallbrook Public Utility District and Rainbow Municipal Water District both left the San Diego County Water Authority in 2024. A date of separation before the switch and a trial date after it can read different water costs. We appraise groves, nurseries, ranches and the homes on them along with the commercial property in the same estate.

Does one spouse keeping a San Diego building trigger a property tax reassessment?

Generally not. Revenue and Taxation Code Section 63 excludes transfers to a spouse or former spouse in connection with a property settlement agreement or a decree of dissolution from the definition of a change in ownership. Ask your attorney or CPA how the rule applies to your transfer and whether the San Diego County Assessor needs a filing.

Do you only do divorce appraisals in San Diego?

No. Divorce work is one example. We appraise every commercial property type, including apartments, office, retail, industrial, hotels, gas stations, land, agricultural, mixed-use and new construction, and every kind of commercial appraisal: lending, estate and date of death, trust, retrospective, partition, partnership buyouts, litigation, eminent domain, tax appeals and consulting, in every California county.
